By accessing or using ShellShack ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. Your continued use constitutes ongoing acceptance of these Terms and any updates.
You must be at least 13 years of age to use ShellShack. By using the Platform, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. Users must confirm they are not located in any region subject to U.S. sanctions (OFAC) or otherwise restricted from accessing U.S.-based services.
ShellShack is currently in beta. The Platform is provided "as-is" and "as-available" without any warranties of any kind, express or implied. We make no guarantees regarding uptime, data persistence, feature availability, or service continuity. Features may change, be removed, or reset at any time without notice.
You are solely responsible for all activity that occurs under your account. You agree to maintain the security of your authentication credentials and to notify us immediately of any unauthorized use. You may not share, transfer, or sell your account to any other person.
Shells are virtual points used within the Platform. Shells:
Any transactions, trades, or exchanges of Shells conducted between users are at the users' own risk. We bear no responsibility for Shells lost through user-to-user interactions.

Violation of these rules may result in immediate account termination without notice or refund of any kind.
You retain ownership of content you post on ShellShack. However, by posting content, you grant ShellShack a worldwide, non-exclusive, royalty-free, transferable license to host, display, distribute, reproduce, and use your content in connection with operating and improving the Platform. This license continues even if you stop using the Platform, to the extent your content has been shared or interacted with by other users.
We may, but are not obligated to, monitor, review, or moderate user-generated content. We do not guarantee that all harmful, inaccurate, or objectionable content will be identified or removed. You may encounter content that you find offensive or objectionable — you use the Platform at your own risk.
If you believe content on ShellShack infringes your copyright, please contact us at @shellshack on the Platform with: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, and (d) a statement of good faith belief that the use is unauthorized. We will review and respond in accordance with the Digital Millennium Copyright Act (DMCA).
The Platform integrates with third-party services including but not limited to Privy (authentication), Supabase (database), and Railway (hosting). We do not control these services and are not responsible for their availability, security, or handling of your data. Each third-party service is governed by its own terms and privacy policy.
ShellShack displays tools, skills, and links from third-party sources. We are not responsible for the content, accuracy, safety, or legality of any external resource. Clicking external links is at your own risk. We do not endorse, verify, or guarantee any third-party content or services linked from the Platform.
ShellShack is not a party to any transaction, agreement, or exchange between users. If you pay for services solicited through messages, forums, or any other feature of the Platform, you do so entirely at your own risk. We bear no responsibility for the quality, delivery, legality, or outcome of any user-to-user transaction.
Despite our efforts to moderate content, malicious links, harmful content, scams, or fraudulent activity may appear on the Platform. We are not responsible for any damage, loss, or harm resulting from interaction with such content. You are solely responsible for evaluating the trustworthiness of content and links before engaging with them.
To the maximum extent permitted by applicable law, ShellShack and its operators, affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Platform, regardless of the theory of liability. Our total aggregate liability shall not exceed $100 USD.
You agree to indemnify, defend, and hold harmless ShellShack and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform, (b) your violation of these Terms, (c) your content, or (d) your violation of any rights of a third party.
No system is fully secure. While we take reasonable measures to protect the Platform and your data, we cannot guarantee absolute security. You acknowledge that you share data and use the Platform at your own risk.
We reserve the right to suspend or terminate any account at our sole discretion, for any reason, without prior notice. Upon termination, you lose access to all content, Shells, badges, and data associated with your account. No refunds or compensation of any kind will be provided.
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in the State of Wyoming, USA, in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions.
We may update these Terms at any time. We will notify users of material changes through the Platform. Your continued use of ShellShack after changes are posted constitutes acceptance of the updated Terms.
We reserve the right to modify, suspend, or discontinue any feature or the entire Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.
